Hard Hat Weather terms of service

Hard Hat Weather is a service of La Porte Weather Now LLC (“we” or “us”), La Porte, Indiana. These terms are written in plain language. By signing up for or using Hard Hat Weather, you agree to them. They also cover Field Day Weather, our farm version: wherever they say Hard Hat Weather or a job site, that includes Field Day Weather and your fields. The text message terms are below.
1. What Hard Hat Weather does
For the job sites you give us, Hard Hat Weather checks the National Weather Service forecast against the weather limits you choose for your trade. On workday mornings it sends a GO, DELAY, or STOP call with the workable hours and the reason. During work hours it rechecks each job site and sends an update if that day's call changes. When the National Weather Service issues a warning that covers one of your job sites, it sends a warning text. On paid plans it also emails the week ahead on Sundays, a weather record the same evening on a day the call kept your crew away, and a monthly weather log of what the nearest weather station recorded. If your trade is snow removal, or you turn them on, it sends a snow & ice call around 6 PM when snow or ice is in the forecast, with an update around 3 AM if the call gets worse. Farms get frost and freeze calls in the evening in spring and fall, heat and cold stress calls for livestock, and a dated spray record by email when they text SPRAYED and DONE. On paid plans you also get, on the 8th of each month, the month's rain and freezing days at the nearest NOAA station next to the 30-year normal. You can see your calls on a dashboard, and on your own calendar through a private link we give you. Texts can come in English or Spanish.
2. Guidance, not a guarantee
Our calls are guidance based on forecasts. Forecasts are sometimes wrong, and conditions at a job site can differ from the forecast for the area. You and your crew leaders make the decisions about work and safety, including following official warnings, OSHA rules, the instructions from your equipment and material makers, and your own safety plans.
Hard Hat Weather doesn't replace Wireless Emergency Alerts on your phone, NOAA Weather Radio, outdoor sirens, or any official warning. If you see or hear dangerous weather, act on it, whatever our last message said.
3. Text message terms
Program: Hard Hat Weather, and Field Day Weather (our farm version), from La Porte Weather Now LLC.
What we send: a GO, DELAY, or STOP weather call for your job sites on workday mornings; an update if that day's call changes (at most 2 a day); texts when the National Weather Service issues a warning that covers one of your job sites; if your trade is snow removal or you turn them on, evening snow & ice calls and an overnight update when the call gets worse; for farms, frost and freeze calls in the evening in spring and fall, and heat and cold stress calls for livestock; replies to texts you send us (like a spray record you start by texting SPRAYED, or a language change); and service messages, like a confirmation when you join. We don't send marketing texts.
Language: texts come in English, or in Spanish for anyone who chooses it: reply ESPANOL for Spanish, ENGLISH for English.
How you join: by checking the text message box when you sign up on our website, or by texting JOIN and your company's join code (it's in the company's welcome email, for example JOIN KEENE) to our Hard Hat Weather number from your own phone (). Every phone joins for itself: we don't text a number until the person who uses it has agreed.
How often: message frequency varies. Usually 1 to 3 texts per workday for each phone, and more on days with severe weather, snow, or frost.
Cost: message and data rates may apply. We don't charge for texts beyond your Hard Hat Weather plan.
To stop: reply STOP to any message. STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, and OPT OUT work too, and so do ALTO, PARAR, CANCELAR, and BAJA in Spanish, or telling us any other reasonable way. We'll send one text confirming you're unsubscribed, then no more texts. To join again, reply START.

4. Email
We email your calls to the address you give us if you don't agree to texts, and if you'd like a copy by email. We also email you about your service: your setup when you sign up, a reminder before your 7-day trial ends, and a note when someone joins your alerts. On paid plans and during your free trial, we also email the week ahead on Sunday evenings, a weather record the same evening on a day the call kept you away, and your weather log on the 1st of each month. Each call email tells you how to stop them.
5. Free trial, plans, and billing
Your first 7 days are free and include everything in the Company plan, and we don't ask for a card to start. After the trial, if you don't choose a paid plan, you move to the Free plan. You never pay unless you choose a paid plan.
- Free: $0. One job site's morning call and National Weather Service warnings, by email.
- Crew: $19 a month. Up to 5 job sites and 5 people, by text or email, updates when the call changes, the week ahead, and the monthly weather log.
- Company: $39 a month. Everything in Crew, for all of your job sites and people.
- Farm (Field Day Weather): $99 a year. Up to 10 fields and 5 people, by text or email, frost and freeze calls, updates when the call changes, the week ahead, and the monthly weather record.
- Special arrangements: priced with you in writing.
Crew and Company can also be paid yearly: $190 and $390 a year. Founding crews: the first 25 companies to start a paid plan keep that plan's price for as long as their subscription stays active, even if our prices go up.
Rain-out guarantee: on the Crew and Company plans, if our morning call for a job site is GO (with no wrap-up time), we don't send a heads-up changing it, and the nearest National Weather Service reporting station records rain or snow for 2 or more of that job's work hours that day, we credit one week of your plan's price (monthly price × 12 ÷ 52) against your next bill. We check this automatically from the weather log. Credits are capped at 4 weeks in any calendar month, have no cash value, and end if you cancel. Station readings decide, even though conditions at your site may differ.
Plans are billed in advance through PayPal (with a PayPal account or a card): monthly, or yearly for the yearly prices and the Farm plan. You can cancel any time; your service runs through the end of the period you've paid for, and we don't refund partial periods except where the law requires it. We'll tell you at least 30 days before any price change.
6. Your job sites and phone numbers
Give us accurate job site locations and work hours, and update us when they change. Only ask people to join your alerts if they've agreed to get them. Anyone can stop texts to their own phone at any time. How we handle this information is in our privacy policy.
7. When things go wrong
We work to send every message on time, but outages at the National Weather Service, our providers, or mobile carriers can delay or stop messages. If a morning call can't be sent, we'll tell you as soon as we can. We may change or improve the service; if a change makes it less useful to you, you can cancel.
8. Limits of liability
To the fullest extent the law allows: the service is provided “as is,” without warranties of any kind; we aren't liable for indirect or consequential losses, like lost work, wages, materials, or profits, that come from the weather, a forecast, or a message that is late, missing, or wrong; and our total liability for any claim is limited to what you paid us for Hard Hat Weather in the 3 months before the claim.
9. Ending the service
You can cancel any time by telling us. We may end service if the account isn't paid or the service is misused, and we'll give notice when we can. When service ends, we stop all texts and emails and delete your information as our privacy policy describes.
10. Changes to these terms
If we change these terms, we'll update the date at the top. For changes that matter, like prices or what we send, we'll tell you at least 30 days ahead. Indiana law governs these terms.
